Aim
This Legal Notice regulates the access to and use of the web portal that Muradit makes available free of charge to Internet users.
Access to the portal implies the complete and unreserved acceptance of the conditions contained in this notice in the version published by Muradit at the time such access takes place. Therefore, the user should read this text carefully every time s/he proposes to use the portal, since it may undergo amendments.
The purpose of the portal is to provide information regarding the products and/or services offered by Muradit as well as to enable the sale or contracting of said products and services.
The sale or contracting of the products and services is governed by the specific conditions of sale contemplated therefor, owing to which such conditions may replace, complement and/or modify this notice. Therefore, prior to the purchase or contracting of said products and services, the user should also read carefully the corresponding conditions of sale and specific conditions.
This Legal Notice will not be filed individually for each user but will remain accessible by Internet on this portal.
Intellectual and Industrial Property
The design of the portal, its source codes, the logos, trademarks and other distinctive signs, texts, drawings, software, photographs, videos, sounds, databases, indices, images, expressions and information and, in general, any other creation protected by national rules and international treaties on intellectual and industrial property (hereinafter, altogether, the “contents”) that appear herein, are the property of Muradit or of third companies or individuals and they are protected by the corresponding intellectual and industrial property rights.
The contents included in the portal may not be modified, copied, reproduced, publicly communicated, transformed or distributed in any way, wholly or partially, for public or commercial purposes, unless previously authorised, expressly and in writing, by Muradit or the holder of the corresponding rights.
Access to the portal and browsing therein by the user shall not be deemed a waiver, transfer, licence or total or partial assignment of the abovementioned rights by Muradit.
The user is not granted any licence for the use of the commercial or registered trademarks, logos, trade names or other distinctive signs.
Muradit respects the intellectual property rights of third parties. Should any person consider that their intellectual property rights may have been breached, they are requested to contact us immediately at the addresses and by the means indicated at the commencement of this Legal Notice.
Access to and use of the portal
Access to the portal is free of charge.
However, some products and services supplied in the portal by Muradit or third parties may be subject to payment. In these cases the conditions of sale and specific conditions established therein shall apply as indicated above in the section entitled “Aim”.
The mere access to the portal does not imply, in itself, the establishment of any type of link or commercial relationship between Muradit and the user, unless they have established this as such and the user has complied with the requirements determined.
The use of the portal does not require, in general, the prior subscription or registration of users without prejudice to the fact that the corresponding user registration may be required prior to accessing the use, purchase or contracting of products and services.
In this case, the user guarantees the veracity and authenticity of the information communicated as a consequence of the registration and likewise undertakes to keep such information updated. The user shall be solely liable for any false or inaccurate declarations made and for any damages caused to Muradit or to third parties by the information s/he provides.
Likewise if, as a consequence of the registration, the user is required to safeguard a password, s/he undertakes to use it diligently and to keep it in a confidential manner. Therefore, the user is solely responsible for safeguarding and using said password, and s/he must communicate to Muradit immediately any event that enables the undue use of usernames and/or passwords, such as theft, loss, or unauthorised access thereto by third parties, in order to proceed to cancel them immediately. Until such events have been communicated, Muradit shall be exempt from any liaibility that may derive from the undue use of the usernames or passwords by unauthorised third parties.
Access to and use of the portal and, if applicable, the purchase or contracting of the products and services that may be offered therein, is the exclusive responsibility of the user who undertakes to observe the indications offered at any time by Muradit.
The user undertakes to use the contents, products and services diligently, correctly and legally.
Electronic communications
Muradit may contact the user by email or by telephone when the latter uses or accesses the sale or contracting of products or services.
When sending commercial or promotional communications we will always request the express authorisation of the user, we will identify the message as such, clarify the sender and give the user the option to opt out from such communications in the body of the message.
Exclusion of guarantee and liability
- For the information, contents and services hosted on the portal
Muradit does not guarantee the availability and continuity of the functioning of the portal, the services and/or its contents, owing to which it shall in no case be liable for damages of any kind that may be due to the lack of availability or continuity thereof, or for failures in access to the different pages of the portal or to those from which the services are provided.
Muradit declares that it has adopted all the necessary measures, within the limits of its possibilities and the state of technology, to guarantee the functioning of the portal and avoid the existence and/or transmission of virus and other harmful components to the users, but it does not guarantee or assume liability for the absence of such virus and other harmful components in the portal or in the server that supplies it, or for the invulnerability of the portal and/or the imperviousness of the security measures adopted therein.
Muradit shall not be liable for the use made by third parties of the information published in the portal, or for the damages suffered or economic losses that, directly or indirectly, cause or may cause economic or material damages, or damages to data, caused by the use of such information or the use of the services.
- For the information, contents and services hosted outside the portal
The portal may make available to users technical devices such as links, directories and search tools (such as, among others, links, banners, etc) that enable access to web pages or sites belonging to and/or managed by third parties for the sole purpose of facilitating to users the search for and access to information, contents and services available on the Internet.
Muradit does not assume any liability for the information and contents existing on said third-party web pages, but does undertake to remove links should it become aware of the existence of illegal contents or those which damage the rights of third parties. Users may communicate with Muradit, by using the contact details offered for such purpose in this notice, to inform of the existence of such contents should they be found.
Any liability for damages of any kind that may be due to the presence of virus or other harmful elements in the services or pages offered by third parties is expressly excluded.
Should a company or user wish to install a link from an external web page to any of the web pages of this portal, they should communicate with Muradit to obtain its express, written consent.
Muradit reserves the right to make changes in the portal without previous notice, in order to keep the information, products, services or design of the portal updated.
Minors
The services and/or products offered via this portal MAY NOT be acquired by minors under the age of 18 without the corresponding consent of their parents or guardians.
Furthermore, this portal is not intended for minors under 14 years of age. Should Muradit be aware of or suspect the registration of a person under the age of 14, it will immediately cancel such registration.
Applicable regulations and conflict resolution
This Legal Notice and Privacy Policy, as well as the other specific conditions and any other matter relating to the products and/or services contained in the portal of Muradit, will be governed in each and every one of their aspects by Spanish Law.
Any users with the condition of consumers or Users as defined by Spanish regulations and who reside in the European Union, if they have experienced a problem with an on-line purchase from Muradit, may access the Online Dispute Resolution Platform, created by the European Union and developed by the European Commission pursuant to Regulation (EU) 524/2013, in order to attempt to reach an out-of-court agreement.
When the user is not a consumer or User, and when not otherwise obliged by any regulation, the parties agree to submit to the Courts of the city of Madrid, since this is the place of execution of the contract, expressly waiving any other jurisdiction that may correspond to them.
